that's probably where this evidence is the most useful. we have a standard in criminal law called the reasonable person standard. this fictitious person that we measure everybody's conduct by. we say this is the person, the average person, the average juror, the average individual, the kind of conduct that we would expect an average member of society to live up to. well, as it turns out that none of us are quite average, right. and we might actually be much more like people who we share particular brain structures with or people who we share particular environmental and brain similarities to. so we might need to start thinking about more particularized notions of conduct based on what we would expect of a person who has that type of brain structure who had these types of environmental factors and then start to think about how we want to treat them. do we want to hold those people responsible for their actions or less responsible for their actions. are there certain people who would be better subject to medical treatment instead of incarcer

all of us have that kid. they touch us for reasons we cannot articulate. i don't know why bobby touched me, his name was little devil but i never wanted to call him by that name. i think about his personality and that maybe the reason. he was 14 years old and had been abused, and was in foster placement with his hat -- aunt. i fell in love with him in the most proper, loving, in the most big sister way. i would say to him, with all the ignorance of the young social worker, i will always be here for you, always. always. it was a friday night, and i had gone on a string of disasters states, this was in the 1980's. we hooked up, but said we didn't. it was 2:00am and i was getting home. i lived in venice, california. the rent was affordable. but this was to in the morning. the house had a wraparound porch. i was walking up to my house, and there was a shadowy figure on the porch. i did what any concert -- god- fearing a young woman did. i reached for my can of mace, and i was prepared. i looked at the chateau -- shadow, and i heard the voice and knew it was bo

in to us as well, which we block. but there's a town, marshaltown, iowa, that recently did a not in our town, not in our community, article on this topic. the newspaper editor was tired of all those negative comments that come in to the newspaper because you see them under the article. at the same time in sioux falls, a town close to them, that had a suicide and the whole community came together to take a positive approach and that kind of combines the two things, looking at how we treat each other online as well as how we treat each other on the community. you can go to our wepb site and see the progression as the whole community came together, the school district, the city, the library and they all worked together saying this isn't what we want in our town and they are being very proactive. another thing is we work with students and they came up with a positive campaign on facebook that they did, we have a little film on cyber bullying where some students in new jersey came together and they called it a virtual hug.

i think that using lewd behavior laws is problematic and ineffective. first of all, there are going to be a lot of borderline cases about whether something is lewd or not lewd and you're putting a police officer in a terrible position of trying to determine is this person a little bit aroused or not aroused, is that adornment on the person's genitals lewd or not lewd, did he shake his genitals a little too vigorously to draw attention. no police officer should make that determination and to be blunt no police officer will. if addition if left with the choice of only charging someone with indecent exposure for lewd behavior under state law as some in opposition to this legislation are suggesting if you're convicted of indecent exposure you become a registered sex offender when you're done. my legislation that we're considering today will not result in sex offender registry. colleagues, as i stated at the beginning -- as i stated at the beginning, i gave this issue time to work itself out. it didn't. and the time has come to act. this is a narrow and reas
